Terms and Conditions of Sale

General provisions and parts of the contract

 

These conditions of sale are valid only between the following parties to the contract:

 

  • SPECIAL PACKAGING EUROPA Srl (hereinafter referred to as ISPEU srl) with registered office in Tagliacozzo (AQ), Via A. Moro 21, Register of Companies of the Chamber of Commerce of L'Aquila, Tax Code and VAT number 01802680668, Buongiorno is a trademark of owned by the Ispeu srl group;

  • CONSUMER, or pursuant to art. 3, I comma, lett. a) of the Consumer Code, the natural person who makes online purchases on the website "for purposes unrelated to any entrepreneurial, commercial, craft or professional activity", hereinafter referred to as "CUSTOMER".

 

Furthermore, for the subjects who enter the VAT number during the purchase procedure, considered an indication of the purchase for purposes related to the entrepreneurial activity, the ordinary discipline of the civil code will apply and not these forms.

 

Pre-contractual information for the consumer in distance contracts

Before concluding the purchase contract, the CUSTOMER examines the characteristics of the goods that are illustrated in the individual product sheets at the time of choice. Before the conclusion of the purchase contract and before the validation of the order with "payment obligation", the CUSTOMER is informed about:

 

  • total price of the goods including taxes, with details of shipping costs and any other costs;

  • terms of payment;

  • the term within which ISPEU srl undertakes to deliver the goods;

  • the procedures for exercising the right of withdrawal as well as the model withdrawal form referred to in Annex I, part B of Legislative Decree 21/2014;

  • information that the CUSTOMER will have to bear the cost of returning the goods in case of withdrawal;

  • existence of the legal guarantee of conformity for the purchased goods;

  • after-sales assistance conditions and commercial guarantees provided by ISPEU srl.

General conditions of sale, acceptance and modifications

​

This site (hereinafter the "Site") is owned by Imballaggi Speciali Europa Srl, owner of the Buongiorno brand, with registered office in Tagliacozzo via A. Moro 21 67069 AQ, tax code and registration with the Business Register of L'Aquila REA AQ n 121889 P. IVA 01802680668 and is dedicated to the retail sale of coffee, soluble products and colonial products and their derivatives, related and complementary products, as well as food products and accessories, to the sale of food and non-food goods in any form, to the sale or rental of equipment relating to the activity of supplying coffee and instant products.

These General Conditions of Sale are drawn up in Italian and English, and govern the offer and sale of products to the consumer on the website www.buongiornocoffee.it: they are prepared in compliance with the principle of consumer protection in accordance with the relative provisions to the distance contract governed by Legislative Decree 9 April 2003, n. 70 containing the regulation of electronic commerce (e-commerce) and articles 45 and ss. of the Legislative Decree 6 September 2005, n. 206 ("Consumer Code") and following amendments.

The CUSTOMER is required to carefully read these General Conditions of Sale, understanding them and accepting them in full without any reservation: pursuant to art. 12, legislative decree n. 70/2003 ISPEU srl makes the general conditions of the contract available to the CUSTOMER so that they can be stored and reproduced, as well as all other information that ISPEU srl provides on the Site, both before and during the purchase procedure.

The General Conditions of Sale applicable to each individual order will always be those in force and displayed on the site on the date of transmission of the purchase order. ISPEU srl reserves the right to make changes or update, in whole or in part, the Terms of use and sale listed below at any time and in any case in compliance with current legislation. Changes and updates to the Terms of Use will be in force between the parties from the time of their publication on the Site in this section and will apply only to sales concluded after publication.

For this reason, the CUSTOMER must consult with attention and diligence, regularly accessing this section to check the publication of any and most recent updates and changes of use.

The detailed information about the details that allow you to contact ISPEU srl quickly, also in order to request assistance, information or submit complaints regarding the use of the site and purchases made through the site are indicated in the Purchases section, or the Customer can consult directly into the sections: Terms and Conditions of Sale, Privacy & Cookie Policy, Shipping and Payments, Returns.

These General Conditions of Sale do not regulate the sale of products and / or the provision of services by parties other than ISPEU srl that are present on the Site through links, banners or other hypertext links.

The CUSTOMER will be required to check their conditions of sale before carrying out commercial transactions with these subjects. ISPEU srl is not responsible for the sale of products by such third parties and / or for the provision of services, nor for the contents of these sites nor for any omissions and / or violations of the law by them.

Registration

​

Registration with username and password is optional. If the CUSTOMER does not wish to register, he can still make a purchase: only the data necessary for the delivery and billing of an order will be requested.

Characteristics and prices of products or services

 

The images of the products may not be perfectly representative of their characteristics but differ in color, size, accessory products represented. All support information for purchasing is to be understood as simple general information material, not referable to the real characteristics of a single product. The products are offered at the price indicated on the site on the date an order is placed. The prices are inclusive of VAT which will be indicated in detail in the purchase invoice of the product, if issued. Prices do not include transport and delivery costs which are in any case indicated in the final section before sending an order and specified in the order receipt confirmation sent by e-mail to the CUSTOMER.

Products and prices

​

The Products sold on the Site by ISPEU are originals marked by trademarks owned by them - and / or licensed to it or in any case with the authorization of their respective owners - and are shipped in their authentic packaging. The essential characteristics of the products are presented on the Site within each product sheet.

All sales prices of the products indicated on the website www.buongiornocoffee.it are expressed in Euros and include VAT, and where applicable, the WEEE contribution.

Shipping costs are not included in the purchase price, but are indicated and calculated at the conclusion of the purchase process and in any case made known to the customer through specific indications on the Site before making the payment. The products are offered for sale at the price indicated on the Site at the time the relevant Purchase Order is placed. The CUSTOMER accepts the right of ISPEU to change its prices at any time, however the goods will be invoiced on the basis of the prices indicated on the site at the time the order is created and indicated in the confirmation e-mail sent by ISPEU srl to the CUSTOMER. .

 

 

Availability of products

The availability of the products refers to the actual availability at the time the CUSTOMER places the order. Even after sending the order confirmation e-mail sent by ISPEU srl, there may be cases of partial or total unavailability of the goods. In this eventuality, without prejudice to the rights attributed to the CUSTOMER by the applicable law, the CUSTOMER will be promptly informed by e-mail and will therefore be entitled to immediately terminate the contract. The CUSTOMER who has already made payment will be promptly refunded the total amount paid, including delivery costs and any other costs incurred, in relation to the order itself.

Any contractual or extra-contractual liability for direct or indirect damage to persons and / or things caused by the non-acceptance of an order for the above reasons is expressly excluded by ISPEU srl.

 

 

Conclusion and effectiveness of the contract

With these general conditions of sale, ISPEU srl sells and the CUSTOMER remotely purchases the movable tangible goods indicated and offered for sale on the website www.buongiornocoffee.it

The contract is concluded through the internet, by accessing the CUSTOMER at www.shop.buongiornocoffee.it and carrying out the purchase order according to the procedure provided for by the site itself, or by telephone at + 39 0524 400707. ISPEU srl, before placing the order, informs the CUSTOMER that the conclusion of the contract will be obtained after completing various intermediate technical phases.

 

  • The CUSTOMER must fill in an order form (hereinafter "Purchase Order") in electronic format and transmit it to ISPEU srl, electronically, following the instructions that will appear on the Site from time to time and that will accompany the different phases of the purchase;

  • The CUSTOMER undertakes to read these general conditions of sale, in particular the pre-contractual information provided by ISPEU srl, before proceeding with the confirmation of his order, and to accept them unconditionally and to observe them in relations with ISPEU srl.

  • Orders that come from subjects who have not reached the age of majority will not be accepted.

  • After payment confirmation, the order can no longer be canceled or modified.

  • Once the Purchase Order has been received electronically, ISPEU srl, within one day from the conclusion of the procedure, will send the CUSTOMER to the indicated email address an "Order Registration Confirmation" email in which all the details of the order itself: the CUSTOMER data and the order number, the price of the goods purchased, the information relating to the essential characteristics of the product purchased, the detailed indication of the price, the means of payment used, the costs of shipping and any additional costs and the delivery address to which the goods will be sent, information, standard instructions on withdrawal and the standard withdrawal form.

  • The CUSTOMER undertakes to verify the correctness of the personal data contained therein and to promptly communicate any corrections to ISPEU srl.

  • The sales contract is considered concluded and perfected with the electronic sending by ISPEU srl to the CUSTOMER of the e-mail confirming receipt of the Purchase Order completed and sent by the CUSTOMER.

  • The purchase order form will be filed in the ISPEU srl database for the time necessary for its execution and, in any case, within the terms of the law.

  • To access their order form, the CUSTOMER can follow the procedure called "Purchase orders". To access the order summary, the CUSTOMER can download it from their account in the "my orders" section, or by contacting Customer Service by writing an email to info@buongiornocoffee.it, by calling + 39 0524 400707.

  • The languages ​​available to users for the conclusion of the contract are: ITALIAN and ENGLISH.

  • The Customer Service is able to communicate with customers in Italian, English and French.

  • The order sent by the CUSTOMER will be binding for ISPEU srl only if the entire order procedure has been completed regularly and correctly without any error messages being highlighted by the Site or not consistent with the commercial policy of these Conditions of Sale, as well as in case of unavailability of the ordered products. In the event that ISPEU srl is not able to fulfill an order received, it will promptly notify the CUSTOMER specifying the reasons and that the contract has not been concluded: if it has already been concluded, it will be considered automatically terminated, without any charge to be borne by the CUSTOMER. Any right of the CUSTOMER to compensation for damages or compensation, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things caused by the non-acceptance of an order against ISPEU srl is expressly excluded.

Billing

​

Before completing the order, the CUSTOMER will have the right for each order to request the issuance of a tax invoice for the goods ordered as indicated during the purchase procedure: to follow up on this request, the CUSTOMER will be obliged to communicate his code to ISPEU srl tax. When ordering, it is necessary to indicate whether the shipping address is different from the billing address. The invoice is available and printable, after the order has been processed, in the "My account" section of the CUSTOMER.

The invoice will contain the information provided by the CUSTOMER during the purchase procedure. No change to the data indicated on the invoice will be possible after it has been issued. For anything not specifically described in this paragraph, these Conditions of Sale are subject to and will apply.

Applicable law and competent court

​

These General Conditions of Sale are subject to Italian law and, in particular, to Legislative Decree 6 September 2005 n. 206 (so-called Consumer Code), with specific reference to the legislation on distance contracts and the legislative decree 9 April 2003 n. 70 on certain aspects concerning electronic commerce.

The competent court for the resolution of any dispute in relation to the application, interpretation and execution of these General Conditions of Sale that does not find an amicable solution will be that provided for by the Italian legislation in force at the time of the conclusion of the contract.

The European Commission provides a platform guaranteed by the European Union for online dispute resolution, which the CUSTOMER can access via this link.

The online dispute resolution platform can be used in all official EU languages: it provides a range of dispute resolution bodies to choose from acting as an intermediary between the buyer and the trader to resolve the dispute without take legal action.

Responsibility

ISPEU srl assumes no responsibility for disservices attributable to unforeseeable circumstances or force majeure, even if dependent on malfunctions and disservices of the internet, in the event that it fails to execute the order within the times provided for in this contract.
